OK, what we are looking at here is greed, stupidity and high level connections with probably a little blackmail and bribery thrown in for good measure. Oh, and a lot of money. Part of the background here is that years ago the original developers convinced the Town to allow them to develop the Spit. They then used it as collateral on a $50 million loan which they "sunk" into other projects. They have since sold the whole island to a hedge fund. So now the new guys look at the Spit and see a possibly "disappearing" asset on the books and they know that they must build the access infrastructure out there before they will be able to unload it to an actual development group. The legal team's argument that if they are not allowed to build the sheet pile wall the whole thing will just erode away tells what a bad idea this is. It's going to erode away no matter what they do!

TOKI has taken over Fresh Fields Village (not on Kiawah) and tried to get Cassique (not yet as far I know). Locating their municipal building outside their boundaries should tell you that they are planning to expand the TOKI.
