SC Supreme Court on Smoking Bans: Keep It Outside Kids

The South Carolina Supreme Court has upheld the Sullivans Island smoking ban.

"We find nothing in our State laws regarding workplace safety indicating the legislature intended to preempt the regulation of indoor tobacco smoke in the workplace," the court's opinion reads.

That means that it's up to the legislature to creat that preemption. While tobacco has a wealth of lobbiests on the case, this would be one tough boulder to roll back up the hill.
