      <![CDATA[There are stories about ICWA being misused (biological parents- both provide INFORMED consent for a child to be placed with a particular adoptive family, but the tribe intervenes.)       <![CDATA[The Indian Child Welfare Act of 1978 states that a parent may not give up their rights until 10 days after the child is born. The father in this case gave them up long before the child was born and therefore null-in-voids his previous statement to give up his rights as the father.

      <![CDATA[Given all the FACTS, it seems the truly fair thing is for Veronica to be with her birth father and her blood family. What I cannot understand is how she was allowed her to be spirited away to Oklahoma without a period of transition.

      <![CDATA[**PER SC SUPREME COURT’S ruling on the case (where they granted baby girl Veronica to her natural father):<br>
•	Birthmother received financial assistance BEFORE and AFTER the adoption paperwork was filed<br>
•	“Initially the birth mother did not wish to identify the father, said she wanted to keep things low-key as possible for the [Appellants], because he's registered in the Cherokee tribe. It was determined that naming him would be detrimental to the adoption.”<br>
•	Prospective adoptive parents, Matt and Melanie Capobianco’s, attorney sent a letter to affirm Dusten’s (Father) Cherokee enrollment; however, the attorney’s misspelled Dusten’s name and misrepresented his birthday (emphasis added)—thus, the Cherokee Nation could not verify the father’s enrollment<br>
•	Dusten signed a paper thinking it was to grant the birthmother full rights before he (Dusten) left for a military deployment (he was leaving the country)<br>
•	Prospective Adoptive Parents (PAPs) filed for adoption 3 days after Veronica was born—waited until Jan 6, 2010 to notify the father (Dusten)—just days before his departure to serve in our military in Iraq.

      <![CDATA[As an adoptive parent of a 1/2 NA child, I know and get to see everyday the damage ICWA and the people that used it has caused my now 6 year old when they took her away from us for 5 months using this law as an excuse. It was not in her best interest, she was mentally abused by her blood family.

      <![CDATA[Whether or not a child is adopted, if the male biological parent says he doesn't want anything to do with the child until she's been with her loving adoptive parents four months, he loses his rights to that child. This is a CHILD - you can't decide off an on whether you want her or not.
