We disagree. In my own home I can smoke, eat spoiled and poisoned food or drink muddy water. I couldn't come into your home and do these things. The same applies to public places. My rights in these matters end where your's begin.
We have delegated to our governments the power to ensure the safety of our water, air and food. This power naturally extends to the air in enclosed places. Preventing a known carcinogen to be spread through the air is the responsibility of government and the duty of citizens to each other.
